ACTION REQUEST (Brief Summary)

Staff is requesting the City Commission to set a Public Hearing to consider the creation of a reinvestment zone, tax abatement request, and accept the application from Del Papa for a tax abatement.

BACKGROUND

Under Chapter 312 of the Texas Tax Code, the City Commission must call a public hearing, not staff, for the tax abatement and reinvestment zone creation needed to grant a tax abatement to Del Papa if the City Commission is inclined to proceed.  City Commission must accept the application to set the hearing.  Once the Public Hearing is set, a notice must be published and each taxing entity must be notified that there is to be a public hearing at least 7 days prior to the public hearing.  To meet Del Papa's deadlines, we want to hold the public hearing on January 19th, thus the need to meet on Monday to call for the public hearing.  The application will be delivered Monday by Del Papa.  The resolution calling for the public hearing will accompany their request.   After the Public Hearing, if the City Commission is inclined, it may grant a tax abatement.  That action item would also be on the January 19th agenda.
