ACTION REQUEST
Applicant Hugh Patrick Constructors, Inc. request a one-year extension of time from May 7, 2026, until May 7, 2027, on the preliminary zoning approval to rezone 6.0821 acres at 2628 Texas Ave from District "E" (General Business) to District "F" (Light Industrial) for third-party storage of industrial equipment, materials and supplies and other uses.
BACKGROUND (Brief Summary)
On May 7, 2025, the City Commission held a public hearing upon advertised notice and thereafter voted to give preliminary zoning approval to the request by Hugh Patrick Contractor, LLC,
to rezone 6.0821 acres at 2628 Texas Ave from District "E" (General Business) to District "F" (Light Industrial) for third-party storage of industrial equipment, materials and supplies and other uses. According to the Texas City Code of Ordinances Section 160.106 (D)(3), this preliminary zoning approval will be converted into a final ordinance to change the zoning map once a building permit application is submitted for the requested uses. The application must be filed within 12 months from the date of the preliminary zoning approval.
Conditions for the preliminary zoning approval including making the site complaint with the requirements of the Gateway Overlay District for landscaping and the requirement of District F-1 Light Industrial to provide a screening wall. These conditions have not yet been shown to be completed. The applicant needs additional time to show these conditions have been met.

RECOMMENDATION
The request for extension of time to the preliminary zoning approval to rezone 6.0821 acres at 2628 Texas Ave from District "E" (General Business) to District "F" (Light Industrial) for third-party storage of industrial equipment, materials and supplies and other uses is scheduled to be heard by the Planning Board at its regularly scheduled meeting on May 4, 2026. Staff will report the action of the Planning Board to the City Commission.
Staff have reviewed the request for extension of time and recommend approval to the Planning Board and to the City Commission of the requested extension of the preliminary zoning from District "E" (General Business) to District "F" (Light Industrial) to allow Hugh Patrick, Contractors, LLC additional time to complete the requirements for the permit.
