ACTION REQUEST (Brief Summary)

Boyd's One Stop (Jason Cogburn) is requesting to re-obtain a lease on the Texas City Dike and start receiving fresh seafood for his business at this location.  Staff has worked on the lease agreement with the Mayor and Jason Cogburn and it is being presented for approval.

BACKGROUND

Boyd's One Stop has had a lease since 1997. Prior to Ike it reverted to an automatic year to year lease. The lease is up for renewal and we needed to adjust for the changes at the Dike including the loss of the piers, new standards for the piers, weight limits for trucks on the road, maintenance, etc.  For the most part the lease is the same.  Due to the extensive repairs that are necessary, it was felt to keep the lease fee the same as prior to the storm.  He had three piers for $600/month.  He wants to start with one pier, so the lease mentions it is $200/month per pier with a maximum of three piers.  Once the lease is signed, Mr. Cogburn will start to remove the remains of all three dilapidated piers and construct one pier.  He is expected to start the first week of May pending approval.  The piers are on the south side of the Dike within the first mile of the levee.  A drawing is attached to the lease.  This will be the first lease on the Dike since Hurricane Ike.  One other lease is considered active, but we have not had success contacting the owner and they have not shown any indication of rebuilding.
