ACTION REQUEST (Brief Summary)
Consider approval of a Resolution authorizing the City to enter into a Utility Services Agreement between, Texas City, GCMUD 53, and 418 Southlake, LTD (Developer).
BACKGROUND
This Utility Services Agreement is primarily a tool and mechanism to assist the Developer and the Municipal Utility District; however, the City will stay a party to the agreement since it is the City that actually provides the utility services. There are provisions in the Agreement for the City to provide some limited number of utility connections to get the neighborhood underway. Then the developer or MUD can implement additional utility projects to provide additional capacity when needed. There are also provisions in the agreement that keep the City from maintaining lakes, ponds, and detention areas. These will be maintained by the MUD or Homeowners' Association.
City staff utilized the services of a consultant, David Oliver with ABHR, to review and provide comments regarding the Agreement. All items have been properly addressed and staff has no objections to approval of the Utility Services Agreement.
