ACTION REQUEST

A RESOLUTION ESTABLISHING THE REGULAR CITY COMMISSION MEETING ON SEPTEMBER 7, 2022 AS THE DATE FOR A PUBLIC HEARING TO DISCUSS AND REVIEW AMENDMENTS TO THE LAND USE ASSUMPTIONS, CAPITAL IMPROVEMENTS PLAN AND UTILITY IMPACT FEES ASSOCIATED WITH THE CITY’S WATER AND SEWER CAPITAL RECOVERY PROGRAM

BACKGROUND (Brief Summary)

Section 395.053, Texas Local Government Code, directs and states that a governing body of the political subdivision shall  adopt an order setting a public hearing to discuss and review the update of the land use assumptions and the capital improvement plan and utility impact fees. State law requires the plan to be updated at least every 5 years.  Texas City last updated its plan in June 2017.   
Section 395.058 of the Texas Local Government Code, directs the governing body of the political subdivision to appoint an advisory committee to advise and assist in adopting land use assumptions; and also provides that the planning and zoning commission may serve as such advisory committee. The Planning Board and the Zoning Commission, meeting jointly, have served as the advisory committee for previous updates of the land use assumptions and capital improvements plan and well qualified to do so.  
 

RECOMMENDATION

The City of Texas City Engineer and Director of Transportation and Planning recommends approving the Public Hearing to be held on September 7, 2022, at 5:00 p.m., in the City Hall Kenneth Nunn City Commission Room and recommends appointing the members of the Planning Board and the Zoning Commission to serve jointly as the advisory committee to review and provide comments regarding land use assumptions and capital improvements plan updates and utility impact fees associated with the City’s water and sewer Capital Recovery Program.
