ACTION REQUEST
Consider and take action ragarding denial of a variance request for 0002 Wincrest Rd., Texas City.
BACKGROUND (Brief Summary)
The applicant seeks to construct a single-family residence upon four lots which total 20,500 sq. ft. (0.47 acre). The property is located in the San Leon area and does not have access to municipal water or sewer services.
The Planning Board considered the matter at its regular meeting on March 20, 2023. Applicant, Eric Miller, had notice of the Planning Board meeting and chose not to attend. The applicant verbally advised staff that he had obtained a septic permit from Galveston County Health District and did not need the variance. The requirements of the ordinance were explained, but the Applicant chose not to attend the Planning Board meeting.

The requirements of the ordinance were explained, but the Applicant chose not to attend the Planning Board meeting.
RECOMMENDATION
The Planning Board concurs with City Staff and does NOT recommend the variance because the finding necessary to support a variance cannot be made for the following reasons:
(i) there are no special geographic conditions affecting the land involved,
(ii) the variance will not preserve the enjoyment of a substantial property right because the applicant has all of the rights to enjoyment which existed when the property was purchased without access to offsite sewer serve. (There is no evidence the applicant has a septic permit from the GCHD).
(iii) the variance would be detrimental to the public health by increasing the housing density in an area which does not have off site sewer serves, and
(iv) the variance will have no impact on the orderly subdivision of the other land in the area because as subdivided it does not comply with the provisions of the Subdivision Ordinance.
