ACTION REQUEST
The Public Works Department is asking the City Commission to approve a Resolution of Support pertaining to a Municipal Setting Designation (MSD) for the City of Galveston. This is a TCEQ requirement and has zero Fiscal Impact for the City of Texas City. See Exhibit A for details of the resolution approval being requested.
BACKGROUND (Brief Summary)
On June 16, 2025, the City Council of the City of Galveston adopted a Municipal Setting Designation (MSD) Ordinance prohibiting the use of designated groundwater as potable water from the 7.07-acre property located at 3916 Winnie Street in Galveston, Texas. Pursuant to the State of Texas, House Bill 3152F, Subchapter W, Section 361.805, the property owner, Galveston 3916 Winnie Street, LP, has submitted an MSD application to the Texas Commission on Environmental Quality (TCEQ). TCEQ review identified a water well owned by the City of Texas City, located within a 5- mile radius of the proposed MSD property. We are being asked to provide a resolution of support and that we are aware of what is going on at the site. The well in question is at the end of the dike and we have as non-potable, it is used as a fish cleaning station. What is going on at this site has no effect on our City well or operations. This is being requested simply to meet the TCEQ requirement below.

RECOMMENDATION
It is the recommendation of the Public Works Department for the City Commission to approve this resolution.
