ACTION REQUEST

Consider and take action on updates that are recommended for codification in the Zoning Ordinance based upon effectiveness in accomplishing the purpose of the ordinance as stated in Section 160.002 and otherwise promote health, safety, morals or general welfare and the safe, orderly and healthful development of the municipality. The recommended updates are as follows:
  1. Revise Section 160.005 Applicability to Existing Regulations paragraph (B) to replace the first sentence in its entirety as follows: “Those plats of property which property was located within Texas City limits and complete with all improvements and duly filed prior to January 1, 1998, shall only be exempt from meeting any new or more restrictive lot width, depth or square footage requirements”.
  2. Revise Section 160.029 District C Multi-family Residential paragraph (E) to add the following:
“(3) At least 45% of the required parking must be covered or enclosed garages”.
“(4) At least 10% of the required parking must be enclosed garages”.
  1. Revise Section 160.030 District C-1 Multi-family Residential paragraph (E) to add the following:
“(3) At least 45% of the required parking must be covered or enclosed garages”.
“(4) At least 10% of the required parking must be enclosed garages”.
  1. Revise Section 160.028 District B-1 Residential Townhomes paragraph (E) to read in its entirety as follows:
“(E) Parking requirements:
“(1) For townhouse residential dwellings, off street parking shall be provided at the following ratios:
Number of bedrooms in unit Number of parking spaces per unit
Efficiency or one bedroom 1.75
Two bedroom 2
Three bedroom 2.5
Four bedroom or greater 3

“(2) The elimination of a parking space in a single-family attached dwelling or a duplex dwelling by enclosing the garage with a stationary building wall shall be prohibited”.(Note: this provision is in the Ordinance as it exists without revision, but is restated here for convenient reference.
“(3) At least one parking space for each unit must be in an attached garage”.
“(4) Each unit with two or more bedrooms must have at least 0.50 additional paved space for guest parking. Guest parking may be combined in a common area with approval by the Planning Board”.

 

BACKGROUND (Brief Summary)

Texas City has an established record of consistent and progressive land use regulation.  The land regulations through the Zoning Ordinance and Subdivision Ordinance promote and support the long term and continuing increase in population through in-migration, increase in property values, increase in business openings and activities, and remarkable growth through development of subdivisions and planned unit developments.  As it exists, the Zoning Ordinance and Subdivision Ordinance rely upon staff and the Administration to establish policies and procedures for the faithful and consistent implementation of the ordinances. In that way the administration of land use regulations remains relevant to market conditions and industry standards.  From time to time it is appropriate to update the Zoning and Subdivision ordinances to capture best practices which have shown to be effective in the implementation of the purpose of the ordinances.

RECOMMENDATION

The Zoning Commission voted unanimously as its special called meeting on Tuesday, April 25 to recommend approval of the following updates to the Texas City Code of Ordinances Chapter 160 Zoning:
  1. Revise Section 160.005 Applicability to Existing Regulations paragraph (B) to replace the first sentence in its entirety as follows: “Those plats of property which was located within Texas City limits and complete with all improvements and duly filed prior to January 1, 1998, shall only be exempt from meeting any new or more restrictive lot width, depth or square footage requirements”.
