ACTION REQUEST

Consider and approve the award of a professional services contract to Intuitive Global Consulting to conduct an Analysis Of Impediments To Fair Housing Choice (AI) in Texas City and produce a final document to be submitted to HUD that encompasses the Analysis and Plan to eliminate identified Impediments.  Give Mayor Johnson the authority to enter into a contract with Intuitive Global Consulting on behalf of the City of Texas City, to be effective on the date of signing for services to commence on June 26, 2023.

BACKGROUND (Brief Summary)

The CDBG program contains a regulatory requirement to affirmatively further fair housing based upon HUD’s obligation under Section 808 of the Fair Housing Act. The CDBG regulation also reflects the CDBG statutory requirement that the grantees certify that they will affirmatively further fair housing.  In order to achieve this goal, the City must identify all impediments to fair housing in Texas City by developing an AI.

The AI is a review of impediments to fair housing choice in the public and private sector. The AI involves:
  • A comprehensive review of the City of Texas City’s laws, regulations, and administrative policies, procedures, and practices.
  • An assessment of how those laws, etc. affect the location, availability, and accessibility of housing.
  • An assessment of conditions, both public and private, affecting fair housing choice for all protected classes.
  • An assessment of the availability of affordable, accessible housing in a range of unit sizes.
Impediments to fair housing choice are:
  • Any actions, omissions, or decisions taken because of race, color, religion, sex, disability, familial status, or national origin which restrict housing choices or the availability of housing choices.
  • Any actions, omissions, or decisions which have the effect of restricting housing choices or the availability of housing choices on the basis of race, color, religion, sex, disability, familial status, or national origin.
A Request for Qualifications (RFQ) was advertised in the Galveston County Daily News and made available on May 11, 2023.  HUBs were emailed the notice that the RFQ was available.  It was advertised again on May 18, 2023.  Qualifications were due on June 1, 2023.  Only one submission, from Intuitive Global Consulting, was received by Purchasing.  IGC was interviewed by the Evaluation Team (Jon Branson, George Fuller, and Kristin Edwards) on June 13, 2023.  The evaluation results were 2 advantageous and 1 highly advantageous.  The contract was then negotiated.

RECOMMENDATION

It is the recommendation of the Qualifications Evaluation Team that it would be advantageous for the Commission to approve the award of this contract.  The completion of the analysis process and the production of the final document, which will include an implementation plan, will allow the City, as a grantee, to be in compliance with HUD regulatory requirements to have an AI submitted.
