ACTION REQUEST
Consider and take action on Resolution No. 2024-110, to acquire rights of way for certain sanitary sewer and drainage projects.
BACKGROUND (Brief Summary)
The 24-inch sanitary sewer force main project is included in the City’s 5-year Capital Improvements Program and funded with revenue from the sanitary sewer impact fees collected in Zone 2, The project is necessary to accommodate additional growth in Zone 2, which can be generally described as the north and west sections of Texas City. Phase I of the project is currently in progress of construction. Engineering and design are complete for Phase II of the project and in the process of being let for bids with construction to begin before year end and be complete within six months thereafter. Additional right of way in the form of sanitary sewer easements is required for the project. Condemnation lawsuits were filed to acquire site control for three of the required parcels so construction could begin. A settlement of the condemnation lawsuits has been reached as indicated in the table.
The South Pointe Drainage Project will improve drainage for the South Pointe Subdivision and is funded with a federal grant. Additional right of way is required for the drainage improvements. An agreement has been reached for the necessary right of way across the Padgett Tract upon terms as indicated in the table. The drainage project is in design and has not yet started construction. Acquistion of this parcel will allow the engineering and design of the drainage project to proceed to completion.
Funds are budgeted and available for these acquisitions.

RECOMMENDATION
Staff recommend approval of the acquisitions and authorization to disburse funds and execute documents as required to close the transactions as approved by the city’s attorneys.
