ACTION REQUEST

Consider and take action on Ordinance No. 2025-018 approving a variance from the 200ft minimum lot width requirement in Section 159.050(F) for lots without access to municipal sanitary sewer service to 106.25ft for 7509 Wetzel to allow construction of a new single-family residence.

BACKGROUND (Brief Summary)

Subdivision Ordinance Section 159.050(F) requires a property which does not have access to off-site sanitary sewer service to have a minimum lot size of two (2) acres and a minimum lot width of at least 200 ft. at the build line. Mariah Garza seeks a variance of the lot width to 106.25ft due to unique circumstances as her residential property located at 7509 Wetzel Drive meets the two-acre minimum but is only 106.25 ft wide.   In accordance with Section 159.050(F)(3)(a) the City Commission may authorize a variance from the 200ft width requirement upon finding the applicant meets certain requirements.  In accordance with the variance procedure set forth in 159.050(F)(3)(c) the Planning Board did consider the variance request at its special called meeting on January 13, 2025 and did make a recommendation to approve the variance request upon certain conditions, which conditions have been met, to wit:
  1. There are special circumstances or conditions affecting the land involved such that the strict application of the provisions of this chapter would deprive the applicant of the reasonable use of his or her land;
  2. The variance is necessary for the preservation and enjoyment of a substantial property right of the applicant;
  3. The granting of the variance will not be detrimental to the public health, safety or welfare, or injurious to other property in the area;
  4. The granting of the variance will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this chapter.
  5. The County Health District has approved the on-site sanitary sewer facilities;
  6. The applicant agrees and has provided a plat as required by city ordinance, which has been approved administratively as a minor plat and is available for recording in the County Deed Records;
  7. The applicant has paid all property taxes and provided proof of such payment.
  8. The property is in excess of one acre of undeveloped land area, excluding water bodies (ponds, lakes, streams and the like); and
  9. Factors other than economic hardship exist that would prohibit the applicant from purchasing enough additional property to meet the requirements of this section.

RECOMMENDATION

The Planning Board and staff recommend approval of a variance to a minimum width requirement from 200ft to 106.25 ft to allow construction of a new single-family residence because the application satisfies all of the requirements of the ordinance for approval of the variance.
