ACTION REQUEST
Consider and take action on a request from Gust George to rezone the 12,382sqft at 8510 FM 517 E, Texas City, TX from District “A-1” (Single Family Residential) to District “E” (General Business) for continued commercial use of the Last Pit Stop Restaurant and Bar.
BACKGROUND (Brief Summary)
On September 21, 2022, the City Commission conducted a public hearing during its regular meeting to gather community feedback and gave preliminary zoning approval to the proposed rezoning of property located at 8510 FM 517 from District "A-1" (Single Family Residential) to District "E" (General Business) for continued commercial use of the Last Pit Stop Restaurant and Bar.
According to the Texas City Code of Ordinances Section 160.106 (D)(3), this preliminary approval will be converted into a final ordinance to change the zoning map once a building permit application is submitted for the requested uses. The application must be filed within 12 months from the date of the preliminary zoning approval. The applicant applied for Building Permit No. 24-010072 for 8510 FM 517 on August 31, 2022, less than 12 months after the preliminary zoning approval.

RECOMMENDATION
Staff has confirmed the requirements for permanent rezoning have been met and that the subject property is in compliance with the requirements of District "E" (General Business) for continued commercial use of the Last Pit Stop. The Chief Building Official advises a complete application was received for the proposed project within 12 months after the preliminary zoning approval by the City Commission.
