a.
Report on the status of the moratorium on the game rooms in Texas City.  (Police Dept.)
 
5.
CONSENT AGENDA: All of the following items on the Consent Agenda are considered to be routine by the City Commission and will be enacted by one motion. There will not be separate discussion of these items unless a Commission Member or citizen so requests. For a citizen to request removal of an item, a speaker card must be filled out and submitted to the City Secretary.
 
a.
Consider approval of the minutes from the July 15, 2009 City Commission Meeting.
 
b.
Consider approval of Resolution No. 09-076 authorizing the Mayor to execute an Interlocal Agreement by and between Galveston County and the City of Texas City to provide partial funding for street improvement of city streets known as 9th Avenue (Palmer Hwy) and 6th Street.  (Transportation and Planning Dept.)  
 
c.
Consider approval of Resolution No. 09-077 authorizing the Mayor to execute an Interlocal Agreement with Dickinson Independent School District providing the citizens of Texas City access and use of Dickinson Independent School District's facilities and programs. (Recreation and Tourism Dept.)
 
d.
Consider approval of Resolution No. 09-078 approving the award of a bid and acknowledging the authority of the Chairman of the Texas City Economic Development Corporation (TCEDC) and the Mayor to enter into a contract for the construction of the new Carver Park Community Center; authorizing the Mayor and Chairman of the TCEDC to approve change orders, not to exceed 25% of the contract amount.  (Purchasing Dept.)

REGULAR ITEMS
 
a.
Consider approval of Ordinance No. 09-28 approving a Settlement Agreement between the Texas-New Mexico Power Company Cities and the Texas-New Mexico Power Company regarding the Company's Statement of Intent to change electric rates in all cities exercising original jurisdiction; declaring existing rates to be unreasonable, adopting tariffs that reflect rate adjustments consistent with the Settlement Agreement and finding the rates to be set by the attached tariffs to be just and reasonable; authorizing the Mayor to execute said agreement.  (Legal Dept.)
 
b.
Consider approval of Ordinance No. 09-27 amending the Code of Ordinances, City of Texas City, Appendix A Zoning, Section 40-11(a) Zoning District Map Description. by rezoning from from "A" (Single Family Residential) to "PUD" (Planned Unit Development) for a mixed use development; being eight parcels of land out of the Motor Subdivision, S.A. & M.G. RR Survey; located in the 7000-7100 block of E.F. Lowry Expressway, Galveston County, Texas City,Texas; ordering said changes made on the City Zoning Map. (Planning Dept.)
