A Regular Called Meeting of the City Commission was held on Wednesday, July 20, 2016, at 5:00 P.M. in the Kenneth T. Nunn Council Room in City Hall, Texas City, Texas. A quorum having been met, the meeting was called to order at 5:01 p.m. by Mayor Matthew T. Doyle.

Financial Quarterly Report (Finance)
Laura Boyd, Finance Director, advised the Commission that 75% of the Budget Year had expired. As
always, our City departments have done a great job keeping their expenses at or under budget. General Fund Revenues year to date is $37,520,028 and the General Fund balance is $21,602,472.

PUBLIC HEARING
a.
Public Hearing to rezone property for John Passalaris/Jerome Karam from "E" (General Business) to "E-4" (Commercial Warehouse) to renovate building for a mini storage facility. Being 3 acres out of Lot 3, Mall of the Mainland Plat. Located at 10,000 E.F. Lowry Expressway # 3000 (Old J.C. Penney Bldg.)
Doug Kneupper, City Engineer, stated that this rezoning request came before the Zoning Commission for a Public Hearing on June 7, 2016. There was no opposition from adjoining property owners. After hearing all pertinent information and discussion, the request was approved with the stipulation that Mr. Karam present a comprehensive plan to the Staff and the portion to be rezoned be amended to include only the 3 acre tract of Lot 3, which will be re-platted at a later date. The only recommendations by the Planning and Zoning Board were that it be 3 acres only, be compatible with other activity uses and repair and install parking improvements, landscape and traffic signs.
Mayor Pro Tem Phil Roberts asked if there would be any outdoor storage to the building?
Doug Kneupper, City Engineer, stated "No."
Commissioner At Large Bruce Clawson asked if the nearby church had any objections?
Doug Kneupper, City Engineer, stated "No."
Commissioner District 3 Dorthea Jones asked if everything in the storage facility will be self contained?
Doug Kneupper, City Engineer, stated "Yes, all units will be inside."
Motion by Commissioner At Large Dee Ann Haney, Seconded by Commissioner District 4 Jami Clark to close Public Hearing,

REGULAR ITEMS
a.
Consider and take action on Ordinance No. 16-24, approving a variance to Section 159.003 ENFORCEMENT of the Subdivision Ordinance allowing the issuance of Building Permits for the Blue Jay Subdivision prior to the recordation of a subdivision plat.
Doug Kneupper, City Engineer, stated, Texas City's subdivision ordinance requires that all public infrastructure (i.e. water, sewer, streets, and drainage) be complete and accepted by the City, and the associated subdivision plat be recorded at the county clerk's office before building permits can be issued. Most of the larger commercial projects take 10-12 months to construct and delaying the building construction until all the public infrastructure is complete would be a significant time and schedule burden for these larger commercial projects. Approval of this variance will allow City Staff to issue building permits prior to the completion of the public infrastructure and recordation of the final plat. At this point the developer is put on notice that a final Certificate of Occupancy will not be issued by the city until all the public infrastructure is complete and the final plat is recorded. The Planning Board reviewed this item at their July 18th meeting and is recommending approval. DSW purchased land and will start construction of infrastructure and houses simultaneously.
Commissioner District 1 Thelma Bowie asked if we can test the water to insure it will be good since the lines are old?
Doug Kneupper, City Engineer, stated "Yes, this will be better engineering and that they will build new lines to prevent problems with water service."
Mayor Pro Tem Phil Roberts asked if the variance has any impact on HUD bonds?
Doug Kneupper, City Engineer, stated "No."
Commissioner At Large Bruce Clawson asked if our current Ordinance doesn't allow them to start?
Doug Kneupper, City Engineer, stated "Correct, which is why we need the variance."
Commissioner At Large Bruce Clawson asked if the City has recourse? As in no issuance of Certificates? No electricity, water, etc?
Doug Kneupper, City Engineer, stated "Correct."
Mayor Doyle abstained from voting on this item.
