ACTION REQUEST
Consider and take action regarding the Development Agreement for the Marlow Lake North Subdivision.
BACKGROUND (Brief Summary)
The City Commission approved the Master Plan for the Marlow Lake North Subdivision at its regular meeting on November 6, 2024. The masterplan will develop a 71.6 acre site on SH 3 immediately north of the Marlow Lake Subdivision into approximately 161 single family lots with lot width ranging from 50ft to 70ft. The City Commission previously gave preliminary zoning approval to a zoning change from District A to District I Planned Unit Development, and then extended the preliminary zoning approval to March 16, 2025. The owner, SSLT, Inc, seeks to annex the Marlow Lake North Subdivision into the GCMUD 79 which requires a Development Agreement. To induce the City into consenting to the annexation of the Marlow Lake North Subdivision into GCMUD 79, the owners agrees to the Development Agreement attached hereto. The Development Agreement provides for the creation of a homeowners association to own, operate and maintain teh detention facilities and common areas, for the underground construction of all dry utilities, and for the construction of homes with a minimum masonry content of 60% brick, stone or masonry among other provisions contained therein.
RECOMMENDATION
Staff recommend approval of the Development Agreement for the Marlow Lake North Subdivision.
