| SUBJECT: | Authorization for the City Manager to Establish Quorum at Canyon Lake Property Owners Association Membership Meetings
|
|
Recommendation:
Adopt Resolution No. 2026-49 authorizing the City Manager to exercise the City's voting rights as a member of the Canyon Lake Property Owners Association (CLPOA) solely for purposes of establishing quorum at CLPOA meetings.
Background/Analysis:
The City of Canyon Lake owns several lots within the Canyon Lake Property Owners Association (CLPOA). Pursuant to Article III, Section 2 of the CLPOA Bylaws, the City is a member of the Association and is entitled to one vote for each lot owned.
The proposed Resolution designates the City Manager as the City's authorized representative to exercise the City's voting rights for the limited purpose of establishing quorum at CLPOA membership meetings. Under this authorization, the City Manager may submit the City's votes as "present" or "abstain," as permitted by the Association's governing documents and voting procedures. The authorization does not permit the City Manager to vote in favor of or against any matter presented to the Association's membership.
The Resolution also authorizes the City Manager to execute and submit any documentation required by the Association to establish the designation. The authorization applies to each qualifying lot owned by the City and will remain in effect unless amended or rescinded by the City Council.
