RECOMMENDATION
Staff recommends that City Council accept two perpetual right-of-way easements from Staley Family Trust for future construction of the Monad Sewer Extension, Phase II.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The Staley Family Trust owns Tract 1, COS 2142 and the unplatted 40-acre property situated directly east. These properties are generally located east of 48th Street West and north of the Monad Drain. The City is proposing to extend a sanitary sewer main along the southern boundaries of these properties, just north of the Monad Drain, constructed with a future project. Phase I of the sewer is currently being constructed with WO 23-07 Monad Sewer Extension. This section of sewer contemplated within the Staley properties was designed with Phase I, and this easement provides the preferred alignment to 48th Street West. The perpetual right-of-way easements will allow for construction of Phase II along the desired alignment. A total of two easements, one on each property, totaling 0.96 acres would be acquired. The sanitary sewer main constructed with Phase I and Phase II will provide gravity sewer service for planned and future developments west of Shiloh Road between King Avenue and Central Avenue in accordance with the sewer master plan.
Compensation of $24,300 for the two new permanent easement areas has been agreed to by the Staley Family Trust based on a restricted-use appraisal of the properties conducted by Thomas Appraisal Services.

ALTERNATIVES
City Council may:
- Accept the perpetual right-of-way easements and agree to compensate for the permanent easements in the amount of $24,300; or,
- Not accept the easements. If the easements are not accepted, the City would not be able to construct the future sanitary sewer in the preferred location.
FISCAL EFFECTS
The compensation in the amount of $24,300 to the Staley Family Trust for the permanent easements was budgeted in FY24 under WO 23-07 Monad Sewer Extension using Wastewater funds. There is adequate budget to pay for the easements.
