RECOMMENDATION
Staff recommends approval of a boundary line adjustment between a City Parking Lot and the Grand Building located at 100 N 27th St, Billings, MT 59101.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
While completing due diligence for the sale of the City-owned parking lot located to the north of the Grand Building, it was discovered that the building may encroach onto the parking lot. The City hired Sanderson-Stewart to survey the boundary line to confirm the encroachment. An encroachment of approximately 0.51' - 0.65' was confirmed. The proposed remedy is to relocate the lot line 0.7' (or 8.4") to the north to ensure that the building no longer encroaches onto the parking lot property. The Grand Building owner agrees to this approach and will cover part of the cost for the lot line adjustment.
Further, the resolution of the Grand Building encroachment is a contingency in the Purchase and Sale Agreement between the City of Billings and Honaker Realty, LLC and JWT Capital, LLC, that council approved on March 11, 2024.

City Council may:

FISCAL EFFECTS
The cost to relocate the lot line is approximately $4,500 in engineering and filing fees. Approximately $1,500 will be paid with Facilities funds and $3,000 will be paid by the Grand Building owner.
