RECOMMENDATION
Staff recommends that City Council approve the First Amendment to the Memorandum of Understanding (MOU) with Yellowstone County for the sharing of costs related to the annual renewal of the Software Support Agreement from Tyler Technologies for our Public Safety Software.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
The City of Billings and Yellowstone County have collaborated and shared in the cost of Public Safety Software expenses from Tyler Technologies (formally New World Systems) for over 20+ years. In October 2023, City Council approved a new 1 year renewable software agreement with Tyler Technologies for the on-going service and support of our Public Safety Software. City Council and Yellowstone County Commissioners also approved an MOU indicating that Yellowstone County agreed to make payment on their share of the Tyler invoice for renewal of the software. The MOU with Yellowstone County agreeing to share in the cost was limited to 1 year, however, the agreement with Tyler Technologies was written for 1 year with the option to auto-renew at the current rates if neither party canceled the agreement within 90 days of the renewal. The First Amendment to this MOU adjusts the original MOU to also auto-renew at the current rates for up to 3 years. In addition, the First Amendment also includes wording that allows the City of Billings and/or Yellowstone County to terminate the MOU in writing at least 90 days in advance of the Tyler Technologies October 31st annual renewal. Essentially, the amendment to the MOU aligns the agreement with Yellowstone County to the Tyler Technologies agreement approved by City Council last year.

City Council may:

- Not Approve
FISCAL EFFECTS
The Tyler Technologies Annual Renewal 1-year support costs with the City of Billings is $254,665. This represents an increase from last year of $29,468, of which, $15,026 is the result of additional modules & licenses purchased and $14,443 is a 6.3% increase in support rates. The First Amendment to the MOU with Yellowstone County confirms their commitment to pay the City of Billings a total of $63,650 for their portion of the 1-year Software Agreement renewal with Tyler Technologies. The City of Billings will be responsible for the remaining $191,115 ($102,006 Police, $52,074 Fire, & $37,035 9-1-1).
