RECOMMENDATION
Staff recommends that Council approve the Resolution of Intent to Create SID 1428 and set a public hearing date for March 10, 2025.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
McCall Development Inc., the developer of Annafeld Subdivision, 5th Filing, desires to construct public improvements in the subdivision that include streetlights. McCall Development would like to complete these improvements utilizing a special improvement district which is allowed through the Subdivision Improvements Agreement for the subdivision. Annafeld Subdivision, 5th Filing, is located south of Elysian Road near Elysian School. The streetlights will be installed along each street frontage. The streetlights will be maintained by the Homeowners Association until all of Annafeld Subdivision is completed. At that point, a Special Improvement Light Maintenance District (SILMD) will be created for maintenance.
McCall Development previously constructed the streets and underground utilities (water, sewer, and storm drain) within Annafeld Subdivision, 5th Filing, totaling $2,259,200.00 worth of improvements. These improvements count toward the required improvements in order to meet the requirements of the City's Raw Land District Requirements (Resolution No. 05-18234). The previously constructed improvements represent approximately 90% of the total improvement costs when including street, utility, and streetlight improvements.
This action is for notice of intent to create the SID and set a public hearing for March 10, 2025, at which time the district may be created.

ALTERNATIVES
The Council may:
• Approve the Resolution of Intent to Create SID 1428 and set a public hearing for the March 10, 2025, City Council Meeting; or
• Not approve the Resolution of Intent to Create SID 1428. If not approved, the streetlight improvements will have to be constructed with a private contract.
• Approve the Resolution of Intent to Create SID 1428 and set a public hearing for the March 10, 2025, City Council Meeting; or
• Not approve the Resolution of Intent to Create SID 1428. If not approved, the streetlight improvements will have to be constructed with a private contract.
FISCAL EFFECTS
The total estimated costs of the improvements are $248,000, which will be paid from the sale of SID bonds and assessed to the properties within the SID boundary. If the costs are greater than the estimated amount, the developer will pay the additional cost.
