RECOMMENDATION
Staff recommends that the City Council approve the Annexation Agreement with Four-S Corp.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
City Council will consider annexation of Lot 3, Block 1, Exchange Subdivision. The property proposed to be annexed is located along 1st Avenue North near the intersection of North 11th Street (see attached exhibit). There is an existing shop located on Lot 3 and the property owner desires to connect to the city sanitary sewer located within 1st Avenue North. The owner owns three buildings: One building in the County (to be annexed under this action), one building already located in the City, and a third building located partially in the City and on leased Burlington Northern Railroad property in the county. Currently, these three buildings are served by the city water main located within 1st Avenue North.
Typically, as a condition of approval of the annexation, the property owner enters into an Annexation Agreement with the City of Billings outlining necessary public improvements. The Annexation Agreement outlines the off-site improvements necessary for development including access to the site, construction of water and sanitary sewer, and storm drain. The Annexation Agreement provides for City-required off-site improvements should the property be annexed and developed without a subdivision plat. The development is located off of 1st Avenue North, which is fully constructed with the required off-site public improvements. Therefore, no public improvements will be constructed with the annexation. Again, the primary reason for annexation of the parcel is to receive City sewer service.
The developer will install the new sewer service from Lot 3, Block 1 to 1st Avenue North at no cost to the City and there will be a sewer system development fee paid to the City by the developer at the time of connection to the City sewer system.

ALTERNATIVES
City Council may:
- If the annexation is approved, then approve the Annexation Agreement with the property owner; or
- Not approve the Annexation Agreement. If the agreement is not approved, Lot 3, Block 1 will not be able to receive sanitary sewer service.
FISCAL EFFECTS
Since this existing development is adjacent to a fully developed street, there would be no financial impact for public improvements associated with the annexation. There will be a sewer system development fee paid by the developer to the City prior to connecting to the public sewer.
