RECOMMENDATION
Staff recommends that City Council award a construction contract to K2 Civil for W.O. 24-32 - North 12th Street Gravel Street Improvements in the amount of $154,570.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
W.O. 24-32 – North 12th Street Gravel Street Improvements will pave North 12th Street between 4th Avenue North and the Burlington Northern Santa Fe Railroad property. The project improves the remaining gravel street in the core of the East Billings Industrial Development area to a paved street. This project came to the attention of the EBURD and was coordinated between the EBURD, the adjacent property owners and the City to develop a shared funding approach and a process to complete the street improvements.
Funding for the project is shared between the East Billings Urban District (EBURD) Tax Increment Fund, the owner of the properties bordering the project addressed as 405 North 12th Street and 1125 4th Avenue North, and the City.
Improvements generally consist of asphalt pavement, concrete valley gutter, and other miscellaneous improvements associated with the work. The bulk of the project is funded with EBURD and property owner funds. City funds will be used to install the improvements within the public right-of-way along 4th Avenue North, which include the replacement of non-compliant accessible ramps and sidewalk, and a concrete valley gutter for intersection drainage. Public Works-Engineering performed the design in-house and will provide construction observation services.
The project was publicly advertised on January 10, 17, 24, and 31, 2025, in the Yellowstone County News and on the City's website. Bids were opened on February 4, 2025. Six bids were received. K2 Civil submitted the lowest, responsible bid. The bid was well below the Engineer's opinion of probable cost of $220,000.

ALTERNATIVES
City Council may:
- Award W.O. 24-32 – North 12th Street Gravel Street Improvements to K2 Civil in the amount of $154,570; or,
- Do not award and reject all bids. If the Contract is not awarded, the street will remain a gravel street, storm events will continue to displace sediment from the gravel surface into the storm system on 4th Avenue North, and the improvements will not be constructed.
