RECOMMENDATION
Staff recommends the City Council approve the final plat of Amended Plat of Buffalo Crossing Subdivision, Lot 1, Block 3.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
On May 6, 2025, WWC Engineering applied for final plat approval for Amended Plat of Buffalo Crossing Subdivision, Lot 1, Block 3. The proposed subdivision creates three (3) lots for multifamily residential development. The subject property is generally located south of Grand Avenue and east of Buffalo Crossing Drive . The property is zoned NX2, Mixed Residential 2.
Staff has reviewed the application using the Administrative Review process outlined in City of Billings Subdivision Regulations Section 23-307. It has been determined that the proposed plat meets all the requirements of subdivision. Staff is forwarding a recommendation of final plat approval to the City Council. Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder.
The administrative review process qualifications are listed below.
Section 23-307. Subdivisions Qualifying for Administrative Review.
A. Eligibility. Subdivisions, hereafter referred to as "administrative review plats" are eligible for administrative review when:
1. They meet the definition of a first minor subdivision from a tract of record or a subsequent minor subdivision from a tract of record; and
This plat creates three lots. The current legal description is: Lot 1, Block 3, Buffalo Crossing Subdivision. The parcel meets the definition of a subsequent minor subdivision.
2. Legal and physical access to all lots is provided; and
Each lot has frontage on Little River Loop within the Buffalo Trail Subdivision.
3. Complies entirely with locally adopted zoning regulations; and
The proposed lots comply with the NX2 zoning. The lots are compliant with size and required street frontage.
4. Complies entirely with the design standards and all other requirements of these regulations; and
This proposed subdivision does comply with the design standards and all other requirements of these regulations.
5. Does not require a variance to any subdivision regulations
No variance was requested for this subdivision.

STAKEHOLDERS
A public hearing is not scheduled for the City Council meeting; however, property owners may attend the City Council meeting and speak during the Public Comment Period. At this time, the Planning Division has received no public comments or questions regarding the proposed subdivision.
ALTERNATIVES
The City Council may approve or deny the final plat of Amended Plat of Buffalo Crossing Subdivision, Lot 1, Block 3. If the City Council chooses to deny the final plat, the denial must be because the criteria in Section 76-3-611, MCA are not met.

(1) The governing body or the agent or agency designated by the governing body shall examine each final plat, and the governing body shall approve the plat only if:

Staff finds the final plat is in compliance with the requirements of state statutes. City Council should approve the final plat.
FISCAL EFFECTS
The final plat of this subdivision will have no financial impact on the Planning Division.
