RECOMMENDATION

Staff recommends that the City Council approve Change Order No. 6 to the Standard Agreement and General Conditions Between Owner and General Contractor/Construction Manager (Construction Contract) with Dick Anderson Construction, Inc. for the W.O. 19-12: West End Reservoir Project in the amount of $2,011,727.93.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

On December 11, 2023, City Council approved a Construction Contract with DAC for the West End Reservoir Project in the amount of $153,211.35.  This initial contract Guaranteed Maximum Price (GMP) allowed the Project Team to begin dewatering the reservoir site through rental of temporary pumping equipment and purchase of permanent dewatering equipment.

Change Order No. 1 for the procurement of an electrical equipment substation for the Raw Water Pump Station (RWPS) for a GMP of $408,352.64 was approved by City Council on August 26, 2024.  Early procurement of this equipment ahead of construction was necessary to maintain overall project schedule due to the 40-week lead time in delivering the project site.

On November 25, 2024, City Council approved Change Order No. 2 for the construction of the BBWA Raw Water Delivery (RWD) Facilities in a GMP amount of $13,553,020.76.  Work includes construction of a BBWA Unloader Structure, Screen Structure, Diversion Channel, Raw Water Pump Station (RWPS), a Canyon Creek Diversion Structure, gravel access roads, and 36, 42, and 60-inch connecting piping.

Change Order No. 3 for dewatering pumping improvements for a GMP of $165,070.04 was approved by City Council on December 16, 2024 and allowed for construction of pumping systems that enabled more efficient winter operations and continuous dewatering of the north reservoir site.

On January 27, 2025, City Council approved Change order No. 4 in the amount of $2,168,482.86 to clear a portion of the future north reservoir cell, remove refuse, and install 5,000 linear feet of permanent dewatering drain pipe.  Exploratory excavation located buried concrete and confirmed depth to shale.  Material excavated to install the dewatering pipe was placed in lifts adjacent to the dewatering trench to 10-12 feet above grade for future installation of WEWTP Zone 3 water transmission main.

Change Order No. 5  to install electrical equipment for BBWA RWD Facilities, to haul approximately 500,000 cubic yards of material from the City’s north reservoir site to Knife River property, and to procure 2 large concrete box culverts and various lengths of FRP pipe for a GMP of $6,102,529.48 was approved by City Council on May 27, 2025.

Change Order No. 6 now under consideration generally includes crossing Hesper Road with a reservoir water supply line, a reservoir drain, a storm water drain, a pedestrian crossing, and a reservoir equalization pipe.  Additionally, this work includes a raw water supply line to the water plant and procurement of additional pipe for reservoir isolation.  The detail of the change order follows:
· Removing and replacing approximately 200 LF of Hesper Road. Cutting, stockpiling, and replacing approximately 11,000 cubic yards of material for installation of large diameter pipe and culvert crossings.  Supporting utilities and installing 6-foot x 5-foot and 8-foot x 8-foot box culverts.
· Installing (by subcontract with COP Construction) approximately 40’ of 24”, 240’ of 30”, 1,940” of 36”, 2,310’ of 42” and 280’ of 48” General Contractor furnished FRP pipe between the Raw Water Pump Station (RWPS, currently under construction) and the West End Water Treatment Plant as well as piping through Hesper Road.
· Deleting installation by Dick Anderson Construction of approximately 1,660’ of 36” and 1830’ of 42” of FRP and ancillary work previously included in the GMP for Change Order No. 2 which is now being performed by COP Construction.
· Procuring additional 36” (360’), 42” (20’), and 48” (20’) FRP pipe, valves, and fittings to enable isolation and independent operation of the north and south reservoir cells.

In order to be ready for summer 2026 WEWTP start-up activities, installation of the raw water piping procured under Change Orders 2 and 5 between the RWPS, WEWTP, and beneath Hesper Road needs to begin in 2025.  Pipe installation pricing is based on the lowest of two bids received June 19, 2025.  Completing the work this summer and fall allows the FRP and large concrete box culverts to be installed in coordination with the future Zone 3 water main (separate contract) and takes advantage of a large out-of-service gas main in Hesper Road.

ALTERNATIVES

City Council may:
  • Approve Change Order No. 6 to the Standard Agreement and General Conditions Between Owner and General Contractor/Construction Manager (Construction Contract) with Dick Anderson Construction, Inc., or
  • Not approve Change Order No. 6.  If Council does not approve this change order, the Raw Water Pump Station cannot be operated to deliver water to the WEWTP and Reservoir.

FISCAL EFFECTS

The W.O. 19-12: West End Reservoir Project was budgeted in FY25 using Water Funds in the amount of $74,000,000.  Considering previously encumbered funds of $22,550,667.13 (Base Contract and Change orders 1-5), and this change order in the amount of $2,011,727.93, there is $49,437,604.94 remaining in the budget.
