PROBLEM/ISSUE STATEMENT

The final plat for Alcor Subdivision is being presented to Council for approval. On September 16, 2010, City staff held a pre-application meeting with the applicant to discuss the creation of a one-lot subdivision of 14,440 square feet of land. It was determined at that time that the subdivision qualifies for the expedited plat review process, which allows, under certain conditions, subdivisions creating one or two lots to proceed straight to final plat review. The subject property is located on the southwest corner of Montana Avenue and North Broadway on railroad right-of-way just north of the tracks. It is zoned Central Business District (CBD). There is an existing three-story brick building on the proposed site (the old Billings Hardware building). One variance has been requested from Section 23-406(B)(6) of the City Subdivision Regulations. The variance would allow the required right-of-way dedication for Montana Avenue to be reduced (see Attachment B) and allow the current street right of way width to remain. The property owner is BNSF Railway Company and Montana Rail Link, and the agent is Sanderson Stewart. Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED

The City Council may approve or deny the final plat of Alcor Subdivision. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in MCA 76-3-611 and BMCC Section 23-305(F).

FINANCIAL IMPACT

Should the City Council approve the final plat, the creation of an individual lot for the existing building will result in its sale and renovation, and an increase in tax revenues for the City.

RECOMMENDATION

Staff recommends that the City Council approve the requested variance from Section 23-460(B)(6), BMCC, and approve the final plat of Alcor Subdivision.
