Title: Public Hearing & Resolution for Nuisance Property Abatement Assessments

RECOMMENDATION

Staff recommends that the City Council conduct a public hearing and pass the attached assessment resolution authorizing staff to alter list if the assessments are paid prior to submitting to the County Treasurer.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

A nuisance property abatement assessment resolution has been completed, and the assessment is ready to be placed on the taxes for the following properties.

(A01314) For the property located at 216 South 30th Street in Billings, MT, a case for open storage was opened on 6/19/24, with the first inspection and first notice sent to that address.  On 7/29/24, a second inspection was conducted, and another notice was sent as there had been no improvement in cleaning up the property.  The code officer continued to work with the property owner to gain compliance; however, there was minimal progress.  The owner was cited into Municipal Court and on 3/13/25, an abatement order was granted.  The property was posted on 7/2/25 informing the owner of the upcoming abatement, and the abatement completed by code enforcement on 7/9/25.  The amount of $789.10 is still unpaid. 

(A18791) For the property located at 3310 First Avenue South, Billings, MT, two cases were opened.  An initial case for open storage and RV for living or sleeping more than five days was opened on 1/3/25 after an initial inspection.  Due to lack of mail delivery to the address (it is an open lot), a first notice was posted on the property.  On 1/23/25, a second notice was emailed to the property owner.  Most communication with this property owner was via email.  On 2/5/25, with a policy standby, the owner was initially cited into Municipal Court for 3/12/25.  The property owner appeared in court; however, the case was not presented at that time as the Court requested the hearing be reset to 4/9/25.  On 4/9/25, the property owner did not appear, and the hearing was held, resulting in an abatement order being granted.    A second case was opened on 2/27/25  for installing a fence that did not match what was approved of in the permit, and a clear vision violation.  The first notice was emailed to the property owner.  On 3/13/25, a second notice was emailed to the property owner.  On 4/17/25, with a police standby, the owner was cited into Municipal Court for 5/7/25.  The owner did not appear in court; the hearing was held; and the abatement order was granted.  On 6/3/25, the property was posted informing the owner of the upcoming abatement.  The abatement was completed on 6/19/25 for both orders.  The amount of $879.38 is still unpaid.




 

ALTERNATIVES

City Council may:
  • Approve; or,
  • Not Approve, in which case the property owners will not be assessed, and the General Fund will be responsible for paying for the abatement.

FISCAL EFFECTS

The assessments total $1,668.48 and will reimburse the General Fund.
