RECOMMENDATION
Staff recommends that the City Council conduct a public hearing and pass the attached assessment resolution authorizing staff to alter list if the assessments are paid prior to submitting to the County Treasurer.
EXECUTIVE SUMMARY
A nuisance property abatement assessment resolution has been completed, and the assessments of $2,724.48 are ready to be placed on the taxes for the two properties.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
(A37427) For the property located at 7089 Copper Bend Blvd in Billings, MT. A case for open storage, and Obstruction on Boulevards. The case was opened on 06/24/2025 with the first notice being sent out. On 7/10/25 a final notice was sent out to gain compliance before a citation would be issued. On 7/31/2025 Property owner was served with a notice to appear. An abatement order was issued on 8/28/2025, which is in effect for a year. Property was posted on 9/23/2025. On 10/2/2025 City of Billings Code Enforcement and Solid Waste removed all open storage in the yards, porch and Public Right of Ways. The invoice was mailed on 10/13/2025 for amount of $1017.00. A second complaint was filed about this address for open storage of debris and Obstruction on boulevards. On 12/29/2025 the property was posted for a second time. On 01/06/2026 City of Billings Code Enforcement and Solid Waste removed all debris in the yards, porch and Public Right of Ways. The invoice was mailed on 1/27/2026 for the amount of $840.50. Total assessment $1,857.50.
(A31697) For the property located at 3323 3rd Ave So. in Billings, MT. On 04/16/2025, Code enforcement responded to a complaint of open storage and spoke to the resident. The violation was explained. The resident was contacted a short time later and the resident assured us that if another couple of weeks were given that the property would be cleaned up. The first courtesy letter was mailed on 05/30/2025. Code enforcement responded back and even after the assurance that the property would be cleaned up, more open storage had been added. An old motor home had been pulled into the driveway and was being dismantled. Items were strewn about the property and more open storage had been added to the boulevard. On 05/30/2025, a second notice letter was mailed. Upon reinspection on 06/13/2025, nothing had been cleaned up and a citation/notice to appear was issued to the homeowner. On 08/15/2025 another derelict RV had been brought onto the property, and it was being dismantled like the prior one. On 08/27/2025, an abatement order was issued by the Billings Municipal Court. On 10/01/2025, the property was posted and on 10/09/2026 the property was cleaned up. On 10/13/2025, the property owner was invoiced. Total assessment $888.98.
