RECOMMENDATION

Staff recommends the City Council hold a public hearing and approve this ordinance on first reading, adding recently annexed property to Ward 5.

EXECUTIVE SUMMARY

Larson Family Properties, LLC, is requesting the annexation and rezone of a portion of land they own currently in the county, but would like to develop as residential and commercial within the city. As part of the annexation of the property into the City of Billings, the relevant election ward must be expanded to contain the annexed property. In this case, Ward 5 is being expanded.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

Sanbell Engineering, on behalf of Larson Family Properties, LLC, submitted a petition to annex land using the provisions of Section 7-2-4600, MCA. The property is located west of the intersection roundabout of Shiloh Road and Zoo Drive. The usage of the term parcel in the below legal description defines the current layout of the annexed property and does not constitute the creation of new lots. The land being annexed is described as: areas of land part of a larger parcel to be situated in Section 22, Township 01 S, Range E, P.M.M., Yellowstone County, Montana, more particularly described as follows:

Tract D of Amended Tract 1-A-2 of COS 1100, Tract 2-B of Amended Plat of Tract 2, COS 1100, and Tract 2-A-1 of Amended Tract 2-A of Amended Tract 2, COS 1100, S22, T01 S, R25 E
Said annexation contains approximately 53 acres gross and net, more or less, including all adjacent Rights-of-Way.

Upon Council approval, this annexation requires a change in the boundaries of Ward 5. Two readings are required for this action. The first reading and public hearing is scheduled for this meeting, April 27, 2026. Upon approval, the second reading will occur May 11, 2026.

FISCAL EFFECTS

This application has no financial impact on the Planning Division Budget.

ALTERNATIVES

City Council may:
  • Approve adding the subject property to Ward 5, or;
  • Disapprove adding the subject property to Ward 5.  Disapproval will not modify the boundary of Ward 5 and create a situation where annexed property is within the city but not within a city ward.
