PROBLEM/ISSUE STATEMENT

The final plat for River Rock Estates Subdivision is being presented to Council for approval. On September 24, 2007, City Council conditionally approved the preliminary plat for this 67-lot subdivision for a period of three years. The City Council later approved a one-year extension to the preliminary approval on September 13, 2010, extending the approval until September 24, 2011. The subject property is located on the west side of 46th Street West, south of Poly Drive. The property is zoned Residential-9600 (R-96) and is planned for single-family residences and proposed for development in phases. The conditions of preliminary approval have been met, including the adoption of a Park Master Plan by City Council. The subdivider is Boyer Land, LLC, and the agent is the Allied Engineering. Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED

The City Council may approve or deny the final plat of River Rock Estates Subdivision. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in 76-3-611, MCA and Section 23-307, BMCC.

FINANCIAL IMPACT

Should the City Council approve the final plat, the creation of 67 additional residential lots will result in an increase in property tax revenues.

RECOMMENDATION

Staff recommends that the City Council approve the final plat of River Rock Estates Subdivision.
