PROBLEM/ISSUE STATEMENT

W.O. 08-20, Miscellaneous Storm Drain Trouble Spots, is an annual Public Works project that fixes multiple existing storm drain trouble spots throughout the City.  One of the areas to be fixed this year is an erosion problem in a drainage swale that exists between two properties in the Briarwood Subdivision area.  Currently, stormwater drains through an open ditch on private property between two homes, causing erosion and settlement concerns.  This project will pipe stormwater runoff to a location that will be able to handle flows without causing erosion problems.  As Briarwood Subdivision was developed in the County, a proper easement allowing stormwater water to drain across private property was never established.  Acceptance of these three easements will formalize an existing drainage channel and allow the City to perform future maintenance on the drainage channel.        

ALTERNATIVES ANALYZED

The Council may:

• Accept the easements thereby providing a formalized agreement to allow stormwater to drain through private property; or
• Not accept the easements and continue to allow stormwater to drain across private property with no formal agreement in place.
 

FINANCIAL IMPACT

There is no financial impact in accepting these three storm drain easements.  The property owners are granting the easements at no cost due to the fact that the storm drain system existed in those locations previously and the easements simply formalized the drainage channel location.  The City funded the storm drain improvements.

RECOMMENDATION

Staff recommends that Council accept the three attached storm drain easements.
