PROBLEM/ISSUE STATEMENT
Dan Marsich is the developer of the new housing complex River Point Homes which consists of 38 units. The complex is located along the north side of Frontier Drive, on Lot 4, Block 1, of Riverfront Pointe Subdivision. Mr. Marsich is requesting a variance from Section 1208 (h)(5) of the site development ordinance pertaining to the number of curb cuts allowed by code. The frontage of the property along Frontier Drive is 950 feet which means that three curb cuts are allowed by code. The applicant proposes five curb cuts as shown on Attachment C of the variance application.
City staff has reviewed the number and spacing of the curb cuts proposed with this development and has determined that two additional curb cuts will have no adverse impacts on Frontier Drive traffic flow. The City Council previously approved two variances for similar designs on the adjacent Lots 2 & 3, Block 1, of Riverfront Pointe Subdivision.

ALTERNATIVES ANALYZED
The City Council may:
• Approve the variance; or
• Do not approve the variance. If this variance is denied, the owner’s options to meet the requirements of the Site Development Ordinances will require redesign with a reduction in the number of curb cuts or replatting the lots to allow the additional curb cuts.

FINANCIAL IMPACT
There is no direct financial impact to the City. Advertising costs for the public hearing are offset by the variance application fee.
RECOMMENDATION
Staff recommends that the City Council approve the variance, allowing 2 additional curb cuts for Lot 4, Block 1 of Riverfront Pointe Subdivision for the River Point Homes project.
