PROBLEM/ISSUE STATEMENT
The Walter Estate, owner of property at South 32nd Street West and Hesper Road, is proposing to quitclaim an existing 30-foot road easement along the property. Berry Y & V, the property owner of Certificate of Survey 1712 located south of the Walter Estate property, is proposing to construct public water and sanitary sewer in South 32nd Street West. Berry Y & V is going to propose to annex its property to be served by water and sanitary sewer. It becomes necessary for the current road easements owned by the Walter Estate to be quitclaimed to the city in order for city water and sanitary sewer to be located within the road. Attached is a copy of the quitclaim deed with an exhibit attached to it.
ALTERNATIVES ANALYZED
The Council may:
• Accept the quitclaim deed of portions of Hesper Road and South 32nd Street West; or
• Not accept the quitclaim deed.
• Accept the quitclaim deed of portions of Hesper Road and South 32nd Street West; or
• Not accept the quitclaim deed.
FINANCIAL IMPACT
There is no significant financial impact with acceptance of the quitclaim deed.
RECOMMENDATION
Staff recommends that Council accept the quitclaim deed for a portion of Hesper Road and South 32nd Street West.
