PROBLEM/ISSUE STATEMENT
The developer of Foxtail Village Subdivision, Second Filing (Cal Kunkel) is requesting a variance from Section 1208 (h) (5) of the site development ordinance pertaining to the number of curb cuts allowed by regulations. Several lots were aggregated into two large parcels to allow for condominium development. The applicant is proposing the same number of curb cuts that would have been allowed with the original lot layout.
The applicant is proposing a total of thirty-five curb cuts; ten curb cuts for Foxtail Lane (north 1/2 Lot 1, Block 2A), twelve curb cuts for the north side of Foxtail Loop West (south 1/2 Lot 1, Block 2A), and thirteen curb cuts for the south side of Foxtail Loop West (Lot 1 & 2, Block 3). Their locations are shown on Attachment 3.

ALTERNATIVES ANALYZED
The Council may:
• Approve the variance; or
• Do not approve the variance. If this variance is denied, the owner’s options to meet the requirements of the Site Development Ordinances will require redesign of the facility to meet the City Code.

FINANCIAL IMPACT
There is no direct financial impact to the City. Advertising costs for the public hearing are offset by the variance application fee.
RECOMMENDATION
Staff recommends that Council conduct a public hearing and approve curb cut variance CC -13 - 02.
