PROBLEM/ISSUE STATEMENT
City Council approved the annexation of Tract 1 of Certificate of Survey 3329 at Hesper Road and Gabel Road at the March 25, 2013, council meeting. As a condition of approval of the annexation, the developer of the property was to enter into a development agreement with the City of Billings outlining necessary public improvements. SunCap Property Group is proposing to build a FedEx facility on this property. SunCap Property Group has submitted the attached Development Agreement, and the Council will consider whether to approve it.
ALTERNATIVES ANALYZED
The Council may:
- Approve the development agreement with SunCap Property Group; or
- Do not approve the development agreement.
FINANCIAL IMPACT
As part of the development agreement, the City will reimburse SunCap Property Group for the construction of the sanitary sewer in Hesper Road due to the fact it is larger than a 12 inch main. All other improvement costs identified within the development agreement will be borne by SunCap Property Group.
RECOMMENDATION
Staff recommends that Council approve the development agreement with SunCap Property Group.
