PROBLEM/ISSUE STATEMENT
The City’s Professional Engineering Services Contract with Morrison-Maierle, Inc. (MMI) for The Briarwood Sanitary Sewer Main Extension Project requires amendment. Council is asked to consider authorizing Amendment No. 7 in the amount of $19,728.00 to compensate MMI for engineering services that were either beyond the scope of the contract or necessary due to unforeseeable project circumstances. Since a significant amount of time was added to the project construction contract through change orders, this compensation request primarily includes extra Resident Project Representative (RPR) time needed for project inspection.
Amendment No. 7 consists of additive components and a deductive component which are described in detail in the amendment itself; these components can be summarized as follows:
• Cost Additive Components
1. MMI’s RPR overtime that was necessary to meet the Contractor’s schedule beyond MMI’s contracted time with the City. The City has already been paid back for this because it was charged back to the Contractor under the project construction contract ($5,415 increase).
2. MMI’s RPR time ($22,512) and engineering staff time ($4,876) on work that was either out-of-scope or necessary due to unforeseen field conditions and resulted in change orders to the construction contract. (combined $27,388 increase).
• Cost Deductive Component
Additional construction contract cost was incurred by the City for the contractor to repair and reinstall sewer force main pipe hangers and thrust restraint assemblies on the Yellowstone River Bridge. Damage to these work items occurred while the force main was being pressure tested because there was insufficient pipe thrust restraint incorporated into the project design. MMI took responsibility for the damage caused by the design oversight. The design was modified and additional pipe thrust restraint assemblies were successfully installed ($13,075.00 decrease).

ALTERNATIVES ANALYZED
City Council may:
• Authorize the Mayor to sign an amendment to the contract with MMI as set forth in this staff memorandum; or
• Not authorize the Mayor to sign an amendment to the contract with MMI as set forth in this staff memorandum.

FINANCIAL IMPACT
The net result of contract Amendment No. 7 to City Work Order 04-36 is a $19,728.00 increase to the contract price. Sufficient FY09 sewer funds are available for Amendment No. 7.
RECOMMENDATION
Staff recommends that Council approve Amendment No. 7 for W.O. 04-36 in the amount of $19,728.00.
