Zone Change #860 - 2nd reading – 439 S. Billings Boulevard

PROBLEM/ISSUE STATEMENT

This is a zone change request from Residential 6,000 to Controlled Industrial (CI) on the North 2 acres of Lot 5 in Section 9, 1 South, 26 East (unplatted), located at 439 South Billings Boulevard. The property has been cleared of debris and currently has two buildings located on it. The applicant is Hanser Properties, LP and is represented by Ralph Hanser. The applicant conducted a pre-application neighborhood meeting on November 30, 2009. The Zoning Commission conducted a public hearing on January 5, 2010, and is forwarding a recommendation of approval on a 4-0 vote. The City Council held a public hearing on January 25, 2010, and approved the zone change on first reading.

ALTERNATIVES ANALYZED

State law at MCA 76-2-304 requires that all zone changes be reviewed in accordance with 12 criteria.
Using the 12 criteria to determine the appropriateness of the zone change request, the City Council may:

1. Approve the zone change request
2. Deny the zone change request
3. Allow withdrawal of the application
4. Delay action for up to thirty (30) days

FINANCIAL IMPACT

If the proposed zone change is approved, redevelopment of the property should increase the City’s tax base and contribute to the South Billings Boulevard Tax Increment Finance District.

RECOMMENDATION

The Zoning Commission recommends approval of Zone Change #860 and adoption of the 12 criteria on a
4-0 vote.
