As part of the Grand Ave widening project, it was necessary to condemn parcels of land in 2006.  J.P.L. Inc. is the owner of Lot 12, Block 4, Sunset Subdivision or more commonly known as 1146 Grand Ave which is one of these parcels.  This is the last parcel of land to be purchased for that project.  The City received right of entry for the Grand Avenue project when the street was constructed. The Grand Avenue widening project resulted in the loss of the off street parking for the business that had been located on this parcel.  As a result, this settlment is for the entire parcel of property and not just the section needed for widening the road.   The City and J.P.L. Inc. have agreed to settle the claim for this property in the amount of $300,067.67. 

The Council may:

• Approve the proposed settlement of $300,067.67; or 
• Not approve the proposed settlement of $300,067.67.  If the settlement is not approved, staff will work through the legal system to try and acquire the property.

The City will pay a total of $300,067.67.

Staff recommends that the Council approve settlement for the stated amount of $300,067.67 for the acquisition of this property.
