PROBLEM/ISSUE STATEMENT
The City of Billings owns property located at 2229 Blue Creek Road with a combined total area of 11.3 acres that was purchased for $550,000 in the summer of 2006 for the purpose of siting and constructing the Briarwood sewer lift station site. The Council is being asked to divide the parcel to create Tract 1 (0.482 acres) for the sewer lift station and Tract 2 (10.871 acres) for resale to the development community. In order to do this, the Council must take three steps:
- Approve the attached proposed lot line adjustments needed to create two new parcels, one of which will be retained for the Briarwood Sewer Lift Station and one of which is intended for sale;
- Approve two (2) attached Utility Right-of-Way Easements for gas and power; and,
- Approve the attached Resolution of Intent to Sell the second parcel and set public hearing date for March 22, 2010.
The current legal description of the proposed Certificate of Survey is: Being Tract 1A of Amended Tr. 1 of the 2nd Amendment of C/S No. 566 and Tr. A-2 of Corrected 2nd Amended Tr. A-1 and A-2 of C/S No. 646 Situated in the SE ¼, Section 20, T1S, R26E, PMM, Yellowstone County, MT.
ALTERNATIVES ANALYZED
The Council may:
• Approve the new Certificate of Survey, the Utility Right-of-Way Easements and the Resolution of Intent to Sell; or
• Not approve the new Certificate of Survey, the Utility Right-of-Way Easements, and the Resolution of Intent to Sell.

• Not approve the new Certificate of Survey, the Utility Right-of-Way Easements, and the Resolution of Intent to Sell.
FINANCIAL IMPACT
The subject property was purchased by the City for $550,000 in the summer of 2006 using wastewater funds and is the current site of the Briarwood sewer lift station (Tract 1, 0.482 acres). Ongoing inquiries from the development community are being made regarding the timing of the remaining property sale (Tract 2, 10.871 acres). If approved for sale, Tract 2 will be sold through the bidding process and the funds will be placed back in the wastewater fund.
RECOMMENDATION
Staff recommends that the City Council:
- Approve the attached proposed lot line adjustments to create two new parcels, one of which will be retained for the Briarwood Sewer Lift Station and one which is intended for sale;
- Approve the two (2) attached Utility Right-of-Way Easements for gas and power; and,
- Approve of the attached Resolution of Intent to Sell.
