PROBLEM/ISSUE STATEMENT
In 1998, the State of Montana deeded Lots 9, 10, 11 and 12, Block 221 of the Second Addition to Billings to the City of Billings. This is property that was unused during the reconstruction of State Avenue. The Public Works Department desires to sell this property. To make the property more sellable, Public Works is proposing to vacate a portion of 7th Avenue South that is unused (0.028 acres) and add it to the City owned property which makes the property larger. To initiate the street vacation, staff completed the request to vacate public right-of-way form. At the same time, staff recommends adding a portion of this property (0.016 acres) to the right-of-way to insure that the existing cul-de-sac will be located completely within the street right-of-way.
ALTERNATIVES ANALYZED
After conducting a public hearing, the Council may:
- approve the vacation of the above-mentioned right-of-way; or
- do not approve the vacation of the above-mentioned right-of-way.
FINANCIAL IMPACT
It is proposed that the right of way revert to the abutting property owner (City of Billings) at no cost because the City owns the property and the right of way.
RECOMMENDATION
Staff recommends City Council conduct the public hearing and approve the vacation of a portion of 7th Avenue South.
