PROBLEM/ISSUE STATEMENT
On January 15, 2015, the Planning Division received an application for preliminary plan approval for the Lee Manufactured Home Park. State statute (76-3-103(15), MCA) defines an area which provides multiple spaces for rent or lease for manufactured homes as a subdivision, and therefore this plan must go through subdivision review. The proposal contains 3 sites for manufactured homes on an 18,800 square foot lot located at 428 Sharron Lane in the Heights. There currently is one inhabited manufactured home on the site, and one that is being torn down and removed. The City Council is being asked to take action on this preliminary plan at this meeting. The owners are Han Lee and John Johnson, and the representing agent is Blueline Engineering.
ALTERNATIVES ANALYZED
In accordance with state law, the City Council has 35 working days to act upon this preliminary minor plan for a manufactured home park. The 35 working day review period for the proposed plan ends on March 9, 2015. State and City subdivision regulations also require that preliminary plans for a manufactured home park be reviewed using specific criteria, as stated within this report. The City may not unreasonably restrict an owner’s ability to develop land if the subdivider provides evidence that any identified adverse effects can be mitigated. Within the 35 day review period or a longer period as agreed to by the developer and City, the City Council is required to:
1. Approve;
2. Conditionally Approve; or
3. Deny the Preliminary Plan
1. Approve;
2. Conditionally Approve; or
3. Deny the Preliminary Plan
FINANCIAL IMPACT
If the City Council approves the preliminary plan, the subject property may be further developed for three manufactured home sites, resulting in additional tax revenues.
