SID 1398 Mountain View Boulevard Public Hearing and Resolution Creating District

PROBLEM/ISSUE STATEMENT

Mountain View Boulevard is a gravel street without curb and gutter.  The City performed a utility replacement project a few years ago and restored the surface to gravel.  There were areas of asphalt but without storm drainage or a grading plan, paving the road could have caused stormwater runoff issues.  Through discussions with the property owners, it was decided that if the City would vacate the street, turning it into private property, the owners would pave it.  The resolution to vacate the street was approved by Council on September 8, 2014.  Due to difficulties that the neighborhood would experience with the vacation and paving, they discussed other options with City staff.  After meeting, it was determined that the neighborhood would form an SID to pay for the stormwater improvements and the City would pave the road.  The neighborhood also decided that they wanted to pave the road wider than the ten feet that was planned so the SID includes an additional two feet of asphalt width.  There are sixteen lots on the upper portion of Mountain View Boulevard that would be assessed for the improvements.  Four owners have two lots each and 8 owners have one lot each.  The properties on the north side of the road will not be assessed because the lots are not constructible and therefore, the road paving does not benefit them.  The Resolution of Intent to create the SID was approved by City Council on May 26, 2015, and the Notice of Passage was advertised June 4th and 11th in the Billings Times.  The protest period for the SID ended on June 19th and the results will be presented at the Council meeting.  If the SID passes, the resolution to vacate the street will need to be repealed.

ALTERNATIVES ANALYZED

The Council may:

• After holding a public hearing, approve the Resolution Creating SID 1398; or
• After holding a public hearing, do not approve the Resolution Creating SID 1398.  If the Resolution is not approved, Mountain View Boulevard will not be resurfaced this construction season.

FINANCIAL IMPACT

The total estimated cost of the improvements is $126,513. The following sources will pay for the project: (1) $51,000.00 of Special Improvement District bonds and (2) $75,513 of cash contribution by the City of Billings. The contribution from the City is from water and storm drain funds.

RECOMMENDATION

Staff recommends that the City Council approve the Resolution Creating SID 1398.
