PROBLEM/ISSUE STATEMENT
The Estates at Briarwood Subdivision 1st and 2nd Filings required the construction of a permanent emergency access road (EAR) for fire apparatus and emergency vehicles. The EAR is required by subdivision regulations and the fire code requires it to be maintained. The EAR was constructed and is currently located between Glengarry Lane and Colleen Drive. This road provides a secondary access point for the development which can be used during an emergency should the main access road become inaccessible. A road maintenance district is required to provide a mechanism to fund future maintenance and repair of the EAR. The EAR is a 20' wide gravel road that over time will require gravel replacement, grading, weed spraying, culvert and gate maintenance, as well as road repairs should major damage occur due to storm or other damage.
ALTERNATIVES ANALYZED
City Council may:
- Approve the Resolution of Intent to Create Road Maintenance District #6 Estates at Briarwood Subdivisions 1st and 2nd Filings and set a public hearing for the August 10, 2015 City Council Meeting; or
- Disapprove the Resolution of Intent to Create Road Maintenance District #6 Estates at Briarwood Subdivisions 1st and 2nd Filings.
- If not approved, the establishment of the road maintenance district will not proceed and future EAR maintenance needs will not be addressed. Additionally, disapproval will result in violation of the Subdivision Improvements Agreement currently recorded for this subdivision.
FINANCIAL IMPACT
Estimated maintenance costs for the EAR are $2,875.00 per year which would be assessed to the property owners. There are 52 lots in the 1st and 2nd Filings of the subdivision. Each lot would be assessed $55.29 per year. There are no significant costs to the city associated with creating the road maintenance district.
RECOMMENDATION
Staff recommends City Council approve the Resolution of Intent to Create Road Maintenance District #6 Estates at Briarwood Subdivisions 1st and 2nd Filings and set a public hearing date for August 10, 2015.
