PROBLEM/ISSUE STATEMENT
The Council memo for the resolution of intent to create SILMD 318 incorrectly stated the public hearing was August 10, 2015. This does not allow enough time for the 15-day protest period mandated by State law. The legal advertising and notice mailed to property owners states the public hearing is at the August 24th meeting. The Council needs to open the public hearing on August 10th and continue it until the August 24th meeting to conform with state law.
ALTERNATIVES ANALYZED
The City Council may:
--Open the hearing August 10 and continue it to the August 24 meeting; or
--Postpone action, which would require re-advertising and re-notifying affected residents.about the a new hearing date; or
--Take no action, which would result in the SILMD not being created.

FINANCIAL IMPACT
There is no financial impact to the City related to continuing the public hearing to August 24, 2015.
RECOMMENDATION
Staff recommends the public hearing be opened on August 10, 2015, and continued until the August 24, 2015, City Council meeting.
