PROBLEM/ISSUE STATEMENT
Staff received a request from residents in the Antelope Place area of Summerhill Subdivision in the Heights to install street lighting. Staff worked with Northwestern Energy Company to design a lighting layout using lights similar to those used in the area east of Summerhill Drive. The lighting would be owned and maintained by Northwestern Energy.
The Council passed a Resolution of Intent to create the lighting district at its July 27th, 2015 meeting. Following passage of the Resolution of Intent, notices were mailed to all property owners in the proposed district and a legal notice was published in the Billings Times in accordance with State law. The Resolution of Intent to Create established a public hearing before the City Council on August 24, 2015, to receive public comment for or against the proposed district.

The deadline for written protests is Friday, August 21, 2015. The number and percentage of valid written protests received will be reported at the August 24, 2015, Council meeting. As provided in State law, the City Council has the authority to create the district if the legal protest does not exceed 50%.
ALTERNATIVES ANALYZED
City Council may:
- Pass the resolution creating SILMD 318 to provide a source of funding for operation and maintenance of the streetlights; or
- Do not pass the resolution that creates the district. If the Council does not adopt the resolution, the property owners cannot be assessed for operation and maintenance of the streetlights, and the new lighting will not be installed.
FINANCIAL IMPACT
All costs of installing, operating, and maintaining the lighting will be paid by assessments against the properties within the district. There are no City owned properties within the proposed district.
RECOMMENDATION
Staff recommends the City Council approve the resolution creating SILMD 318.
