PROBLEM/ISSUE STATEMENT
On September 8, 2014, the City Council conditionally approved vacating a portion of Mountain View Boulevard at the request of residents. During the process of working on the details of the agreement conditions, the residents and City staff were able to agree on a process by which the desired improvements to the street could be accomplished without conveying the right of way to the residents. On June 22, 2015, the City Council created SID 1398 to construct improvements on Mountain View Boulevard. The Council is being asked to repeal the right of way vacation.
ALTERNATIVES ANALYZED
City Council must conduct a public hearing and then may:
- Approve the Resolution that repeals the Mountain View Blvd. right of way vacation, or;
- Do not approve the resolution and do not repeal the previously adopted street vacation resolution. If the right of way vacation proceeds, the property owners along Mountain View Boulevard will own the right of way. However, due to conditions placed on the vacation and the reluctance of the property owners to meet the condition, the vacation would not include the requested conditions such as public pedestrian access.
FINANCIAL IMPACT
There is no financial impact to the City for repealing this street vacation. As a note, one of the conditions of the vacation was that the City would transfer funds reserved for paving the street to the neighborhood. The funds were used to meet the City's contribution for the street paving completed under the SID 1398 project.
RECOMMENDATION
Staff recommends that City Council adopt a resolution that repeals the resolution to vacate a portion of Mountain View Boulevard.
