PROBLEM/ISSUE STATEMENT

On November 16, 2015, the Planning Division received an application for preliminary subsequent minor plat approval for Amended Lot 1, Block 4 of Moody Subdivision, 2nd Filing. The plat contains two lots on approximately 17,360 square feet of land for residential development.  The proposed subdivision is located on the northeast corner of the intersection of Bench Blvd. and Ahoy Ave.  The lot currently has one single family dwelling and a new single family dwelling is proposed for the second parcel.  The owner is Milton, LLC. The representing agent is Sanderson Stewart.
 

ALTERNATIVES ANALYZED

In accordance with state law, the City Council has 35 working days to act upon this subsequent minor preliminary plat. The 35 working day review period for this proposed plat ends on January 6, 2016. However, due to the holiday meeting schedule, the applicant has requested in writing a one week extension to the deadline so that the review period will end on January 11, 2016.  State and City subdivision regulations also require that preliminary plats be reviewed using specific criteria, as stated within this report.  The City may not unreasonably restrict an owner’s ability to develop land if the subdivider provides evidence that any identified adverse effects can be mitigated.  Within the review period, the City Council is required to:
  1. Approve;
  2. Conditionally Approve;or
  3. Deny the Preliminary Plat

FINANCIAL IMPACT

Should the City Council approve the preliminary plat, the subject property may further develop under private ownership, resulting in additional tax revenues.

STAKEHOLDERS

A public hearing is not scheduled for the City Council meeting, however nearby property owners may attend the City Council meeting.  The Planning Division has received no public comments or questions regarding the proposed subdivision. 
 

CONSISTENCY WITH ADOPTED POLICIES OR PLANS

Consistency with the 2008 City of Billings and Yellowstone County Growth Policy, the 2014 Transportation Plan Update, the 2011 Billings Area Bikeway and Trail Master Plan, and the Billings Heights Neighborhood Plan are discussed within the Findings of Fact.
