PROBLEM/ISSUE STATEMENT

Staff is requesting that the City Council consider authorizing and executing Contract Amendment No. 2 for Professional Services with Kadrmas, Lee & Jackson, Inc. to provide street light design services for W.O. 15-07 Orchard Lane. The original contract scope was for design and bidding services for the road, but did not include street light design services.  The intent was to create the street improvement light maintenance district (SILMD) before the design amendment was requested, however, with the decision to create the SILMD using an alternate assessment method to address property owner concerns, the SILMD is not created yet.  This contract amendment for the street light design needs to proceed now, ahead of the SILMD creation, or the construction of Orchard Lane will need to be delayed.  Street projects the size of Orchard Lane are typically awarded in the spring and construction runs into October.  If the street lights design is delayed, the project will not be awarded until summer and there will not be enough time to complete the project in one construction season.  Staff would then need to decide whether to start the project and take a winter shutdown or just delay until the summer of 2017.  While it is a slight risk to begin the design now, there has been no indication from property owners along Orchard Lane that there will be protests to the SILMD now that the assessment method has been modified.  

Amendment No. 1 was for construction administration services and was approved by City Council on January, 25, 2016.


 

ALTERNATIVES ANALYZED

The Council may:
  • Authorize Contract Amendment No. 2 with KLJ for the amount of $21,800.00; or
  • Do not authorize Contract Amendment No. 2.  If Amendment No. 2 is not authorized, street lights will not be constructed with the road project if the SILMD is created.

FINANCIAL IMPACT

The funding for Contract Amendment No. 2 is available from the SBURD TIF and is included in the FY16 budget. If Amendment No. 2 is authorized, the Professional Services Contract with KLJ will total $458,900.00.

RECOMMENDATION

Staff recommends that Council authorize the Mayor to execute Contract Amendment No. 2 with KLJ in the amount of $21,800.00.
