PROBLEM/ISSUE STATEMENT
Popelka Enterprises petitioned to vacate a portion of Montgomery Street near Hansen Lane. The property owner is proposing to re-develop the area and the Montgomery Street right of way will be utilized in the development. Montgomery Street only extends a short distance south of Hansen Lane and appears to be a driveway into the Albertsons. Since the street cannot be extended in the future, there is no need to have this portion of street. There is a sanitary sewer main and storm drain in Montgomery, and it will remain in place and the city will require an easement over the sanitary sewer and storm drain to perpetuate rights to the sewer and storm drain. The area of the right of way proposed to be vacated is 3,900 square feet.
ALTERNATIVES ANALYZED
The Council may:
- After holding a public hearing, approve of the vacation of the above-mentioned right-of-way and accept the easement; or
- After holding a public hearing, do not approve the vacation.
FINANCIAL IMPACT
George Warmer from Coldwell Bankers has established value of the right of way at $5.05 per square foot. The total value of the right of way is $19,695.
RECOMMENDATION
Staff recommends that the City Council conduct a public hearing and approve the vacation of a portion of Montgomery Street and accept the easement.
