PROBLEM/ISSUE STATEMENT

At the June 13, 2016 meeting, City Council delayed action on the vacation of Montgomery Street to the June 27th meeting.  Popelka Enterprises petitioned to vacate a portion of Montgomery Street near Hansen Lane.  The petitioner is requesting that the right of way be reverted to Lot 11 of Block 2 Hansen Subdivision, which is owned by Popelka Enterprises.  The property owner on the other side of Montgomery Street is in support of vacating the property and transferring it to Popelka Enterprises.  Popelka is proposing to re-develop the area and the Montgomery Street right of way will be utilized in the development.  Montgomery Street only extends a short distance south of Hansen Lane and appears to be a driveway into the Albertsons.  Since the street cannot be extended in the future, there is no need to have this portion of street.  There is a sanitary sewer main and storm drain in Montgomery, which will remain in place and the city will require an easement over the sanitary sewer and storm drain to allow future maintenance.  The area of the right of way proposed to be vacated is 3,900 square feet.

ALTERNATIVES ANALYZED

The Council may:
  • After holding a public hearing, approve of the vacation of the above-mentioned right-of-way and accept the easement; or
  • After holding a public hearing, do not approve the vacation.

FINANCIAL IMPACT

George Warmer from Coldwell Bankers has established value of the right of way at $5.05 per square foot.   The total value of the right of way is $19,695.

RECOMMENDATION

Staff recommends that the City Council conduct a public hearing and approve the vacation of a portion of Montgomery Street and accept the easement.
