Public Hearing - Hi-Mile Tire - Variance #CC 16-01 from Curb Cut Requirements

PROBLEM/ISSUE STATEMENT

Hi-Mile Tire is proposing to construct a new store at 2604 Belknap Avenue. The company is seeking a variance from the following City Codes.
 
  1. City Code allows two curb cuts along each frontage (Section 6-1208(h)(3). With this development, they are proposing to have three curb cuts along Nall Avenue.  
  2. Curb cuts cannot be greater than 40 feet in width (Section 6-1208(h)(5) for businesses requiring trucking. The development is proposing the middle approach to be wider than 40 feet. This is to allow garage stalls to be placed immediately adjacent to Nall Avenue.
  3. City Code also does not allow backing into public right-of-way (Section (I)(7).  The development is proposing a loading dock adjacent to Nall Avenue.  They will have to either back into it or out of it in order to load.
  4. The developer is also asking for a variance from having to construct sidewalk along Nall Avenue.  This area will have few or no pedestrians because there is only one of other property on Nall Avenue, south of this development and the street ends at that property.   

The new Hi-Mile Tire will be constructed at the corner of Belknap Avenue and Nall Avenue, which is located east of South 27th Street and near Interstate 90. The Interstate terminates Belknap and Nall Avenue is a dead-end street south of Belknap Avenue. There are only three properties utilizing Nall Avenue for access.  Due to the extremely low volume of traffic on Nall Avenue, Engineering is recommending approval of the variances.  

ALTERNATIVES ANALYZED

The Council may:
  • Approve the variance which allows the applicant to construct a tire store at 2604 Belknap Avenue as proposed; or
  • Do not approve the variances. If the variances are not approved, the site plan will have to be re-designed to meet City Code.  The applicant has stated that this would be difficult for this site.

FINANCIAL IMPACT

The administrative cost of the variance is offset by the application fee.

RECOMMENDATION

Staff recommends that the City Council approve the variances from the site development code for the proposed tire store at 2604 Belknap Avenue.
